By accessing or using Memory Space ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
Memory Space is a collaborative photo sharing platform that allows users to create "memory spaces" for events, places, or themes, and invite others to contribute photos. The Service includes web-based tools for uploading, organizing, viewing, and sharing photos.
To use certain features of the Service, you must create an account. You agree to:
You retain ownership of all content you upload to Memory Space ("User Content"). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and providing the Service.

Space owners may moderate content submitted to their spaces. Additionally, we reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice. We are not obligated to monitor all content but may do so at our discretion.
Paid subscription plans are billed in advance on a recurring monthly or annual basis and renew automatically until canceled. You can cancel at any time from your billing page; cancellation takes effect at the end of the current billing period, and you keep full access until then. When you upgrade to a higher plan, the change may take effect immediately and be charged right away, prorated for the unused portion of your current plan. Downgrades take effect at the end of the current billing period.
Event and Season Passes are one-time purchases, not subscriptions — they never renew automatically. Each pass includes a fixed upload window followed by a view-only period, both shown before you buy. You may renew a pass to start a new cycle; renewing before the current upload window ends extends your time rather than replacing it.
If a subscription lapses or is canceled, spaces beyond the Free plan's limits are archived. When a pass's view period ends, its spaces are archived. Archived content is retained for 30 days, during which you can restore it by resubscribing or renewing, or download your photos using the export feature. After the 30-day retention period, archived content is permanently deleted and cannot be recovered. We send email reminders before each of these steps.
If something isn't working, or you purchased by mistake, contact us within 14 days of the charge and we'll work with you on a refund. Except where required by law, charges for partial billing periods and passes that have been substantially used are generally not refundable.
Payments are processed by Stripe. We never see or store your full card details.
The Service, including its original content, features, and functionality (excluding User Content), is owned by Memory Space and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, and we may delete your content.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MEMORY SPACE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless Memory Space and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
We may modify these Terms at any time. We will notify you of significant changes by posting a notice on the Service or sending you an email. Your continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Memory Space operates, without regard to its conflict of law provisions.
